ORDER

Heard both sides.

2.The writ petitioner executed the petition mentioned settlement deed in favour of her son and presented the same for registration. The respondent declined to accept the document and issued the impugned refusal check slip. Challenging the same, this writ petition has been filed.

3.The learned Additional Government Pleader points out that the property stood in the name of one Kuppan in the UDR and there is nothing on record to show that Kuppan sold the petition mentioned property in favour of the writ petitioner through a registered sale deed. 4.This stand of the respondent cannot be faulted. Be that as it may, it appears that Kuppan had sold the property through an unregistered sale deed. Such a document cannot be acknowledged. But then, the jurisdictional Tahsildar after holding enquiry as directed, mutated the patta in favour of the writ petitioner vide proceedings dated 29.06.2024. 2/4

As on date patta stands only in the name of the writ petitioner. Therefore, the petitioner can very well re-present the document on the strength of the patta. The document shall be accepted for registration by the respondent and released subject to the fulfilment of the other usual formalities. The order impugned in this writ petition is quashed. 5.This writ petition is allowed accordingly.
