PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the 1st Respondent Police to instruct the 2nd and 3rd respondent Police shall not to harass the petitioner under the guise of enquiry without any case. For Petitioner :Mr.K.Prakash For Respondent :Mr.M.Sakthi Kumar Government Advocate (Crl. Side) O RDER This Criminal Original Petition is filed to direct the 1st Respondent Police to instruct the 2nd and 3rd respondent Police shall not to harass the petitioner under the guise of enquiry.

2. On that ground, this petitioner is also one of the victim in the Neomax Properties Private Limited, he is unncessarily harassed by the third respondent herein, this petition has been filed.

3. The learned Government Advocate (Crl.Side) would submit that even though the petitioner is not an accused in Crime No.03 of 2023, he is working as agent in the above said company. Apart from that he is one of the depositors. 2/4

Further, the fourth and fifth respondents gave a complaint stating that the petitioner is a representative of the above said Neomax Properties Private Limited, he collected the money and thereafter, failed to return the same and cheated. The complaint given by the fourth and fifth respondents is pending.

4. Let the petitioner appear before the third respondent and co-operate with him to complete the process of enquiry or investigation as the case may be. There is no question of harassment here. During the course of enquiry or investigation as the case may be, if any trouble arises, the petitioner can workout his remedy through appropriate proceedings.

5. With the above said direction and liberty, this Criminal Original Petition is disposed of.
