Respondents PRAYER:- Writ Petition - filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to remove the encroachment made by Palapatti and Iythampatti people in the Sri Arulmigu Manali Mariamman Temple and furthermore direct the respondents to protect the right of worship of the petitioner and pangalies to the temple on the basis of the representation dated 28.07.2025 as expeditiously as possible.

ORDER

(Order of the Court was made by DR.ANITA SUMANTH, J.) This writ petition is an abuse of process of Court. The prayer is for a mandamus directing the respondents to remove an encroachment on a private land.

2. The writ petitioner accedes to the position that the encroachment, if any, is on land that is stated to be owned by a Temple. Hence, the appropriate remedy would only be to approach the Civil Courts.

3. Secondly, the petitioner seeks protection of their rights to worship. No case is made out as to how there is any hindrance to the exercise of their right.

4. Though sorely tempted to impose costs, we desist. 3/5

5. On the earlier occasion, since the petitioner had stated that the electricity connection of the Temple has been terminated, we had asked the standing counsel to take instructions and Mrs.M.Kiruthika, learned counsel for R4 confirms that the same is live. This is recorded.

6. This Writ Petition stands dismissed in the light of this order. No costs. Consequently, connected Miscellaneous Petition is closed.
