For Respondent : Mr.T.Sakthikumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS / 438 of Cr.P.C COMMON PRAYER :- For Anticipatory Bail in Crime Nos.33, 235 and 237 of 2024 on the file of the respondent Police.
COMMON ORDER : The Court made the following order :- The petitioner is accused No.2 in Crime No.237 of 2024 for the offences punishable under sections 147, 148, 294(b), 323, 307 and 506(ii) IPC, on the file of Kovilpatti West Police Station, Thoothukudi District; he is accused No.3 in Crime No.235 of 2024 for the offences punishable under sections 147, 148, 294(b), 436, 427 and 506(ii) IPC and Section 3 of Tamil Nadu Public Property (Prevention of Damage and Loss) Act and Section 3 of Explosive Substances Act, 1908 on the file of Kovilpatti West Police Station, Thoothukudi District; and he is accused No.2 in Crime No.33 of 2024 for the offences punishable under sections 147, 435 IPC and Sections 3 and 4 of Tamil Nadu Public Property (Prevention of Damage and Loss) Act on the file of Koppampatti Police Station, Thoothukudi District. He is apprehending arrest in these cases and as such, he has filed these petitions seeking anticipatory bail.
2. The case of the prosecution is that due to previous motive, the petitioner and 2/4
other accused have picked quarrel with defacto complainant and also attacked him with Aruval and also threatened the defacto complainant with dire consequences. Hence, the complaint.
3.The learned counsel for the petitioner submits that the petitioner has been implicated in all three cases, since he happens to be the relative of the main accused. 4.The learned Government Advocate submits that the earlier application filed by the petitioner was dismissed and also submits that the petitioner is having 23 previous cases and hence, prayed for dismissal.
5. The petitioner has moved these applications by referring the order passed by this Court in Crl.O.P.(MD) No.13289 and 13290 of 2024 stating that the co-accused already released on bail. The learned Government Advocate submits that the petitioner is having 23 cases to his credit.
