ORDER : The Court made the following order :- The petitioner/A5, who apprehends arrest at the hands of the respondent 1/3

police for the offences punishable under Sections 8(c), 20(b)(II)(B) and 29(1) of NDPS Act in Crime No.144 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on secret information, on 24.08.2023, the respondent Police conducted vehicle check-up and found 2kgs of contraband. Based on the confession given by A1, the respondent Police has registered a case in Crime No.144 of 2023, against the petitioner and other accused. The petitioner is arrayed as A5 in this case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. Hence, he seeks anticipatory bail.

4. The learned Additional Public Prosecutor appearing for the respondent Police would submit that the petitioner along with other accused were found in possession of 2kgs of ganja. He would further submit that the petitioner is an agent and he has supplied ganja to the other accused and hence, he opposed to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the gravity and nature of serious allegations against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. 2/3

7. Hence, the petition stands dismissed.
