DECREE : This Appeal coming on for hearing on this day upon perusing the grounds of Appeal, the order of the Lower Court, and material records of the case and upon hearing the arguments of Mr.C.Jawahar Ravindran, Advocate for Appellant and of Mr.T.Selvakumaran, Advocate for 1st Respondent and 2nd respondent not appearing eigther in person or through advocate and this Court while dismissing the Civil Miscellaneous appeal doth order and DECREE as follows :

i) that the award passed by the Motor Accident Claims Tribunal Additional Subordinate Judge, Karur, in M.C.O.P.No.118 of 2012 dated 15.11.2012 be and hereby is confirmed ;

ii) that the appellant /Insurance Company be and hereby is directed to deposit the entire award amount with proportionate interest and costs to the credit of the claim petition, within a period of four weeks from the date of receipt of a copy of this https://hcservices.ecourts.gov.in/hcservices/ order, if not deposited already ;

iii) that on such deposit, the 1st respondent/Claimant be and hereby is permitted to withdraw the same, by filing necessary application before the Tribunal below; and iv) that there be no costs in this Appeal.
