[Order of the Court was made by DR.G.JAYACHANDRAN, J.] This civil miscellaneous petition has been filed seeking to condone the delay of 1060 days in the filing the above writ appeal.

2. This Court ordered notice to the respondent on 13.11.2024. Though the respondent has been served with notice and his name has been

printed in the cause list, there is no presentation for him either in person or through his counsel and no counter has been filed till date.

3. In view of the answer to the reference given by the Full Bench of this Court vide common Judgment dated 07.01.2026 in W.A.(MD) No.432 of 2023 etc., batch, the order dated 11.11.2021, passed in W.P.(MD) No.131 of 2018, needs revisit. Hence, we are inclined to condone the enormous delay of 1060 days.

4. Accordingly, this civil miscellaneous petition is allowed and the delay of 1060 days in filing the above writ appeal is condoned.
