The Civil Miscellaneous appeal has been filed against the order of remand passed in A.S.No.21 of 2011 on the file of the Principal Subordinate Judge, Kumbakonam, dated 11.09.2012 filed against the Judgment and decree passed in O.S.No.96 of 2005 on the file of the District Munsif cum Judicial Magistrate Papanasam, dated 23.10.2010.

2.The learned counsel for the appellant submits that the matter has been settled out of Court. He has also made an endorsement to that effect.

3.In view of the above, this Civil Miscellaneous Appeal is dismissed as infructuous. No Costs. Consequently, the connected M.P. (MD).No.1 of 2013 is also dismissed.
