Decree : This Appeal coming on for hearing on this day and upon perusing the grounds of Appeal, the order of the Lower Court, and material papers relating to this Appeal and upon hearing the arguments of Mr.J.S.Murali, Advocate for the Appellant and Mr.V.Sasikumar, Advocate for the 1st respondent and the second respondent not appeared either in person or by an Advocate, this court doth order and decree as follows; 1.That the appellant herein/Insurance Company be and hereby is directed to deposit the entire amount together with interest within a period of eight weeks from the date of receipt of a copy of this order, if not already deposited and the Civil Miscellaneous Appeal is dismissed;

2.That on such deposit being made, the claimant be and hereby is permitted to withdraw the entire amount without filing any formal petition before the Tribunal;

3.That the Appellant herein/Insurance Company be and hereby is at liberty to recover the award amount from the insured as per the law laid down by the Hon'ble Supreme Court in the case of Oriental Insurance Company Ltd. Vs. Nanjappan and others reported in (2004) 13 SCC 224; and https://hcservices.ecourts.gov.in/hcservices/

4.That there be and hereby no costs in this Civil Miscellaneous Appeal.
