Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Mandamus, to direct the 2nd respondent to file appropriate application before the 3rd respondent to cancel Pattas 1860, 489, 2894 and 1381 for Survey Nos.111/1A, 111/1B, 111/2A and 111/2B of Paramankurichi Village, Tiruchedur Taluk, Thoothukudi District and restore the same in the name of Goddess Arulmigu Sundara Natchiyamman Temple, Paramankurichi Village.

ORDER

The petitioner, with a grievance that the second respondent/the Joint Commissioner of HR&CE Department, Thoothukudi, has failed to take appropriate action to restore the lands belonging to Arulmigu Sundara Natchiyamman Temple, has submitted a representation and filed this writ petition for a Mandamus directing the second respondent to file necessary application to cancel the patta for the lands in Survey Nos.111/1A, 111/1B, 111/2A and 111/2B of Paramankurichi Village, 2/6

Tiruchedur Taluk, Thoothukudi District and restore the same in the name of Arulmigu Sundara Natchiyamman Temple, Paramankurichi Village.

2. The case of the petitioner is that the above lands have wrongly been classified during UDR survey and patta was also issued in favour of individuals. In this regard, the petitioner has submitted a representation to the second respondent requesting him to file necessary applications before the District Revenue Officer, Thoothukudi, to correct the mistakes committed during UDR survey and to cancel the patta granted in favour of individuals and restore the said lands in the name of Arulmigu Sundara Natchiyamman Temple, Paramankurichi Village. Since the second respondent has not acted upon, the petitioner has filed this writ petition.

3. Today, when the writ petition is taken up for hearing, the learned Special Government Pleader, who takes notice on behalf of 3/6

respondents 1 to 3, on instructions, submits that necessary applications have been filed before the District Revenue Officer, Thoothukudi, to restore the temple lands.

4. In view of the submission of the learned Special Government Pleader that necessary steps have been taken to restore the temple lands, this writ petition is closed with a further direction to the 3rd respondent to expedite the said process and conclude the same, within a period of six months from the date of receipt of a copy of this order. No costs.
