ORDER: The Court made the following order:
The petitioner/Accused, who was arrested and remanded to judicial custody on 18.07.2024, for the offence punishable under Sections 294(b), 506(ii), 147, 148, 120 (B) & 302 IPC, in Crime No. 387 of 2023, on the file of the respondent police, seeks bail.
2.In the instant case, the petitioner was enlarged on bail and since he jumped over the bail, a non-bailable warrant was issued against the petitioner on 12.01.2024, Ultimately, he was secured and remanded to judicial custody on 18.07.2024.
3. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that there are 18 previous cases pending against the petitioner. Because of the attitude of the petitioner, absolutely, there is no progress in this case. Totally there are 7 accused in this case. The case is now pending before the Judicial Magistrate, Thiruvidaimaruthur, Thanjavur District in PRC No.12 of 2023. 4.In the considered view of this Court, once the petitioner has jumped bail and as a result of the same, there is no progress in the proceedings and also considering the fact that the other accused persons are regularly appearing before the Court, this Court is not inclined to enlarge the petitioner on bail at this stage. The learned Magistrate will have to commit the case before the Court of Sessions and after the Sessions Court takes the case on file and charges are framed, this Court will consider the petition for grant of bail.
