PRAYER: This Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to issue an order or a direction, directing the respondents to produce the body of the detenu T.Arun, S/o.Thavamani aged about 31 years who has been missing from 29.10.2019 and set him at liberty.

O R D E R

This Criminal Original Petition is filed to direct the respondents to produce the body of the detenu T.Arun, S/o.Thavamani aged about 31 years who has been missing from 29.10.2019 and set him at liberty.

2. The case of the petitioner is that she has married the alleged detenu Arun S/o. Thavamani on 25.02.2018 at Arulmigu Subramanian Swami Temple, Thiruchendur and it was love marriage. Thereafter, they are living at Seeman Nagar, Madurai and a child is born to them and the alleged detenu was working as Conductor in TNSTC attached to Ulaganeri Bus Depot, Madurai and from 29.10.2019 the alleged detenu was found missing and the petitioner had suspected that her husband detenu Arun was in unlawful detention by some unknown persons and thereby had filed the petition, seeking for a direction to produce the alleged detenu, Arun S/o. Thavamani before this Court.

3. Today, when the matter is taken up for hearing, the second respondent has produced the alleged detenu, Arun S/o. Thavamani before this Court. This Court enquired the detenu and he submitted that he was not in illegal detention and he further submitted that he has not married the petitioner and that the child is not born to him and that the petitioner is black-mailing him and his family members and for that reason only he has left from Madurai and he is presently working in Tirupur.

4. In view of the same, the Criminal Original Petition stands closed. However, the second respondent is directed to proceed further in accordance with law with regard to the complaint of the petitioner.
