ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Clasue 6(4) of TNSC (RDCS)Order 1982 r/w 7(1)(a) (ii) of the Essential Commodities Act, 1955 in Crime No.108 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 22.07.2023, when the respondent police conducted inspection, they stopped a vehicle bearing Reg.No.TN-07-BT-8767 and it contained 194 bags of rice(each contains 50 kgs). Hence, the case. 3.The learned counsel appearing for the petitioners would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. Hence, he seeks anticipatory bail. 4.The learned Government Advocate(Crl.side) appearing for the respondent police would submit that the petitioner is having two similar previous cases and hence, he strongly objected to grant anticipatory bail to the petitioner. 2/3

5.Considering the nature of allegations levelled as against the petitioner and considering the previous bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
