Respondents PRAYER:Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the second respondent not to harass the petitioner by interferring into the civil subject matter in connection with the property situated in Survey No.130-A (RS No.328/9) measuring to an extent of 36 cents, Esanthimanagalam village, Thovalai Taluk, Boothapandi Sub Division, Kanyakumari District pursuant to the complaint given by the third respondent.

ORDER

This Criminal Original Petition has been filed to direct the second respondent not to harass the petitioner by interferring into the civil subject matter in connection with the property situated in Survey No.130-A (RS No.328/9) measuring to an extent of 36 cents, Esanthimanagalam village, Thovalai Taluk, Boothapandi Sub Division, Kanyakumari District pursuant to the complaint given by the third respondent.

2. The learned counsel for the petitioner would submit that earlier the third respondent had given a complaint before the https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL.O.P.(MD).No.18976 of 2019 District Crime Branch and enquiry was conducted and closed and further the third respondent has given a fresh complaint before the second respondent based on which the petitioner is being harassed.

3. The learned Additional Public Prosecutor appearing for the first and second respondent would submit that the third respondent has given a complaint before the second respondent in which enquiry was conducted and the same closed. The same is recorded.

4. It is made clear, now that the complaint has been closed, the respondent shall not call the petitioner in the guise of enquiry and harass him.

5.With the above observation, this Criminal Original Petition is closed.
