For Respondent : Mr.B.Thanga Aravindh, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL UNDER SECTION 482 OF BNSS PRAYER :- For Anticipatory Bail in Crime No.15 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner / Accused No.3, who apprehends arrest at the hands of the 1/4
respondent Police for the offence under Sections 406, 420, 294(b), 506(i) an 120B of IPC in Crime No.15 of 2023 on the file of the respondent Police, seeks anticipatory bail.
2. The case of the prosecution is that Accused Nos.1 and 2 assured to deliver solar panel to the defacto complainant within a specified time and received huge amount of money. After receiving the amount, the money was not paid. There are totally three accused persons in this case and the petitioner has been arrayed as Accused No.3.
3. The petitioner filed anticipatory bail in Crl.O.P.(MD).No.16980 of 2023. The same was dismissed by this Court by an order dated 27.09.2023. Thereafter, the petitioner again filed Crl.O.P.(MD).No.17594 of 2024 and the same was also dismissed by an order dated 19.10.2024.
4. Even when the earlier petition was dismissed, it was informed to this Court that the investigation has been completed and charge sheet has been filed before the concerned Court. In spite of the same, this Court dismissed the petition.
5. The present anticipatory bail has been filed on the ground that the police report has been taken on file in C.C.No.681 of 2024. The numbering of the Calender Case by itself is not change in circumstances. The completion of the investigation and filing of the final report was infact informed to this Court even during the last 2/4
hearing and in spite of the same, this Court dismissed the anticipatory bail petition. Therefore, this Court does not find any change in circumstances. The learned Government Advocate also brought to the notice of this Court that the Court below has issued summons to the petitioner to appear before the Court and the case is posted on 20.02.2025.
