ORDER:This Civil Miscellaneous Appeal coming on for hearing on this day upon perusing the grounds of Appeal, the order of the Lower Court, and the material papers relating to this case and upon hearing the arguments of Mr.C.JAWAHAR RAVINDRAN, Advocate for the appellant and Mr.J.Ahamed Kumar, Advocate for Respondent 1, this Court while allowing this appeal partly doth order and decree as follows:-
1. That the Award of compensation amount granted by the lower court is hereby reduced from Rs.3,37.087/- to Rs.2,91,487/-
2. That the claimant is here be entitled for a sum of Rs.2,91,487/- with interest rate at 7.5% per annum as compensation.
3. That the appellant/Insurance Company hereby directed to deposit the entire awards amount with accrued interest and Costs, of lot already deposited.
4. That the awards of the Motor Accidents Claims Tribunal Cum Chief Judicial Magistrate, Pudukottai, dated 13.06.2011 made in MCOP 224/2009 is hereby and here be made filed and the appeal as partly allowed.
5. That there is no Costs in the appeal.
