Heard the learned counsel on either side.

2, The petitioner is a holder of Indian passport. The validity period had expired. The petitioner applied to the authorities for renewal of passport. On account of the pendency of the criminal case, the application is not being processed. That led to the filing of this writ petition.

3. It is not in dispute that the criminal case against the petitioner is pending only at the FIR stage. Therefore, there is no impediment for renewing the passport.

4. In this view of the matter, the first respondent is directed to renew the passport to the petitioner at the earliest subject to fulfilment of the other usual formalities. 5.The writ petition is allowed accordingly. No costs. 13.12.2022 Index : Yes / No Internet : Yes/ No PMU 2/4
