This criminal original petition has been filed for a direction to direct the respondents 1 to 3 to take action to transfer the investigation of the case relating to the case in crime No.238 of 2019 on the file of the fifth respondent to any other Deputy Superintendent of police other than fourth respondent. 2.Today when the matter is taken up for hearing the learned Government Advocate(Crl.Side)would submit that based on the complaint given by the defacto complainant the respondent police conducted enquiry and closed the complaint as ' Mistake of Fact' and https://hcservices.ecourts.gov.in/hcservices/

RCS notice is served on the petitioner.

3. At this juncture the learned counsel for the petitioner would submit that RCS notice has not been served either through Court or police.

4.Recording the aforesaid submission, this Criminal Original Petition is closed. However the petitioner is at liberty to file a protest petition before the concerned jurisdictional Magistrate in accordance with law.
