ORDER

The petitioner has sought for transfer of investigation in Crime No.160 of 2025 from the file of the third respondent to the second respondent alleging lethargic investigation and for not registering the case under Sections 307 and 326 IPC.

The learned Additional Public Prosecutor, on instructions, would submit that the FIR was registered on 01.08.2025 and the third respondent has been conducting the investigation in a fair manner; that in fact, the offences were altered to Section 294(b), 323, 324 and 506(2) IPC (Section 296(b), 115(2), 118(1) and 351(3) of BNS) and statements of five witnesses have been recorded; and that investigation would be completed and final report would be filed within a period of one month.

3. In view of the aforesaid submission, this Court is of the view that it would be premature to hold that the third respondent is not investigating the case in a proper manner. The third respondent is therefore directed to complete 2/4

the investigation within a period of one (1) month from the date of receipt of a copy of this order. It is needless to say that if any other offence is made out, the third respondent may include those offences also in the final report.

4. With the above observations, this Criminal Original Petition stands closed.
