Magistrate in Cr.M.P.No.147 of 2022 and quash it as illegal and consequently direct the respondent bank to give breathing time and accept part payment and thereby reclassify the loan account as performing account ORDER:- This Writ Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s.B.P.Rathna Prakash, Advocate for the Petitioner and of M/s.M.Jegadeesh Pandian,Advocate for the respondent(s), this Court made the following order:
Challenging the order dated 17.03.2022 passed by the learned Chief Judicial Magistrate, Madurai in Cr.M.P.No.147 of 2022, the petitioners filed the aforesaid Writ Petition. This Court, by an order dated 10.10.2022, disposed of the said Writ Petition, directing the petitioners to pay a sum of Rs.7,50,000/- on or before 10.11.2022 and another sum of Rs.7,50,000/- on or before 10.12.2022. Since the petitioners are unable to comply with the aforesaid conditional order, they filed this petition seeking extension of time to comply with the said order.
2.Considering the facts as well as the submissions made by the learned counsel for the petitioner, we are not inclined to extend the time fixed in the order dated 10.10.2022 passed in W.P.(MD) No.11234 of 2022. Accordingly, this Writ Miscellaneous Petition stands dismissed. However, it is for the petitioners to workout their remedy before the appropriate forum.
