DECREE : This Civil Miscellaneous Appeal coming on for hearing on upon perusing the grounds of Appeal, the order of the Lower Court, and the Material papers in this Appeal and upon hearing the arguments of Mr.A.K.Baskara Pandiyan, Advocate for the Appellant, and MR.M.P.SENTHIL, Advocate for the first Respondent and the Second respondent not appearing either in person or by an Advocate, this Court while doth order and decree as follows :-
1) That the quantum of compensation of a Sum of Rs.53,000/- (Rupees fifty three thousand only) with interest at the rate of 7.5% perannum awarded by the Motor Accident Claims Tribunal(I Additional Sub Court) Madurai, dated 09.09.2009 made in M.C.O.P.No.642/2006 be and hereby is confirmed, and this Civil Miscellaneous Appeal is dismissed.
2) That the appellant be and hereby is not entitled to an order of pay and recovery.
3) That there be no order as to costs in this Civil Miscellaneous Appeal.
