O R D E R
This criminal original petition has been filed for a direction to to transfer investigation of the case in Cr.No.104/2019 pending on the file of the 8th respondent police to any other independent agency or C.B.C.I.D. officer under the direct supervision of the 5th respondent and further to file the final report in the said case within a reasonable time period to be fixed by this Honourable Court 2.Today when the matter is taken up for hearing the learned Additional Public Prosecutor that based on the complaint given by the defacto complainant the respondent police conducted enquiry and closed the complaint as ' Mistake of Fact' and RCS notice is served on the petitioner.
3. At this juncture the learned counsel for the petitioner would submit that RCS notice has not been served either through Court or police.
4.Recording the aforesaid submission, this Criminal Original Petition is closed. However the petitioner is at liberty to file a protest petition before the concerned jurisdictional Magistrate in accordance with law.
