Prayer : Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus directing the third respondent not to proceed with any further steps concerning Na.Ka.No.4101/A4/2024 with regard to the suit schedule property in Natham Survey No.11/21 situated at Puliyankulam Village, Madurai South Taluk, Madurai District until the disposal of the pending civil suit in O.S.No.1012 of 2024 before the Principal Sub Court, Madurai.

O R D E R
This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the third respondent not to proceed with any further steps pursuant to Na.Ka.No.4101/A4/2024 in respect of the suit schedule property in Natham Survey No.11/21, situated at Puliyankulam Village, Madurai South Taluk, Madurai District, until the disposal of the civil suit in O.S.No.1012 of 2024 pending on the file of the Principal Sub Court, Madurai.

2. The petitioner's family has been in possession and enjoyment of the property for the past 125 years. The property was originally occupied by the grandfather of the petitioner's husband under the Natham Settlement Scheme. However, certain alterations and deletions were made in the revenue records in respect of the property. Taking advantage of the same, the fifth respondent filed a petition on 01.12.2023 before the third respondent seeking cancellation of the patta and falsely claiming that the disputed property includes temple land. The petitioner has also filed a civil suit, which is still pending. Without considering the same, the third respondent proceeded with the proceedings. Therefore, the petitioner has been constrained to file the present Writ Petition.
3. The learned Special Government Pleader appearing for the first to fourth respondents would submit that the petitioner's objection to the proceedings would be considered and appropriate orders would be passed by the third respondent within a period of twelve weeks.
4. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to conduct an enquiry, consider the Page No. 3 of 5
petitioner's objection and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. It is needless to state that before passing any order, the petitioner, the fifth respondent and any other parties who may be affected by such decision shall be heard. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
