PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents to release the petitioner's land or pay adequate compensation, in light of resolution made by the 5th respondent dated 27.1.1970, by considering petitioner's representation dated 28.08.2019. ORDER
This Writ Petition is filed to direct the respondents to release the petitioner's land or pay adequate compensation, in 1/3
light of resolution made by the 5th respondent dated 27.1.1970, by considering petitioner's representation dated 28.08.2019. 2.It is the case of the petitioner that though he made a representation dated 28.08.2019 to the respondents seeking either to release his land or to pay compensation with attendant benefits for the belated payment till date, so far no action has been taken. Hence, the present writ petition.
3.In reply, the learned Standing Counsel appearing for the 5th respondent would submit that the petitioner's representation dated 28.08.2019 will be duly considered on merits and in accordance with law, within a time frame to be fixed by this Court. 4.Having regard to the limited scope of the prayer made by the petitioner, this Court, without expressing any opinion on the merits of the case, directs the 5th respondent to consider the representation of the petitioner, dated 28.08.2019 and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order, after providing opportunities to the petitioner. It is needless to say that the petitioner is also directed to enclose a copy of this order along with such representation. 5.This Writ Petition stands disposed of, with the above direction. No costs.
