ORDER : The Court made the following order :- Sankarapandian and Suseela are suo motu impleaded as petitioners in this petition.
2.Heard the learned counsel appearing for the petitioners and the learned Government Advocate(Crl. Side) appearing for the respondent.
3. The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under sections 406, 1/3
420, 506(ii) and 306 of I.P.C., in Crime No.295 of 2019 on the file of the respondent police, seek anticipatory bail. 4.The petitioners' counsel states that the petitioners cannot be blamed for the unfortunate death of the victims. The victims have suffered extensive business loss and therefore, they have committed suicide. It is not fair to blame the petitioners for the same. 5.The petitioner's counsel brought to my notice the detailed suicide note written by the deceased. In the suicide note, serious allegations have been made against the first petitioner. Of-course, the petitioners 2 and 3 have also been named in the suicide note. 6.I am of the view that while venting the anger against the first petitioner, the petitioners 2 and 3 along with the first petitioner's wife have also been implicated.
I have already granted anticipatory bail to the first petitioner's wife. 7.I am of the view that the petitioners 2 and 3 stand on the same footing as that of the first petitioner's wife. Therefore, even while granting anticipatory bail for the petitioners 2 and 3, in view of the serious allegations made against the first petitioner herein, this criminal original petition is dismissed as regards the first petitioner.
8. Accordingly, the petitioners 2 and 3 are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.II, Virudhunagar, and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only)each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners 2 and 3 shall appear before the respondent police as and when required for interrogation. The petitioners 2 and 3 shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.
9. The petitioners 2 and 3 shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
