ORDER

The present Civil Revision Petition has been filed challenging the order passed by the learned I Additional District Judge, Madurai, in I.A.No.2 of 2024 in O.S.No.190 of 2023, dated 28.08.2024.

2.Heard Mr.R.Narayanan, learned Counsel for the Revision Petitioner and Ms.T.Shivashree, learned Counsel representing Mr.J.Bharathan, learned Counsel for the respondents.

3.Today, when the matter is taken up for hearing, the learned Counsel for the respondents submitted that even though the respondents have made an endorsement that they have no objection to allow the application in I.A.No. 2 of 2024 in O.S.No.190 of 2023, the learned I Additional District Judge, Madurai, has dismissed the same. Hence, she submitted that the respondents have no objection for appointment of Advocate Commissioner.

4.In view of the submission made by the learned Counsel for the respondents, the impugned order passed by the learned I Additional District Judge, Madurai, in I.A.No.2 of 2024 in O.S.No.190 of 2023, dated 28.08.2024, is hereby quashed and the application in I.A.No.2 of 2024 in O.S.No.190 of 2023 is allowed. The learned I Additional District Judge, Madurai, shall nominate a Advocate Commissioner, who in turn, shall complete the entire proceedings and shall file a report within a period of four months from the date of appointment.

5.Accordingly, the Civil Revision Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed. 18.02.2026 Internet :Yes/No NCC :Yes/No Index :Yes/No cmr To The I Additional District Judge, Madurai.
