ORDER
The petitioner seeks a Writ of Mandamus, to direct the respondent to rectify and alter the petitioner's date of birth as 09.01.1980 instead of 12.04.1961 in his passport bearing No.W5488938.
2. The petitioner submits that he was initially issued a passport on 10.12.2002, which was valid up to 09.12.2012. On the strength of this passport, he travelled to Saudi Arabia for employment. While working in Bahrain, the said passport expired, and he renewed it for a further period of 10 years, from 08.10.2012 to 07.10.2022. He further submits that although the error in recording his date of birth existed in the originally issued passport, he did not take steps to rectify it at that time, as he had to travel abroad urgently.
3. The petitioner has now filed the present application before the respondent seeking correction of the date of birth. He also appeared in person before the respondent with supporting records to establish that his correct date of birth is 09.01.1980. However, the respondent has not considered his request. Hence, the petitioner has come before this court.
4. Even according to the petitioner, he was aware of the incorrect date of birth at the time of issuance of the passport. In paragraph 6 of the affidavit, he has stated as follows:- 2/5
"6. I respectfully submit that even the time of issuance of first passport, this mistake of wrong entry made in my date of birth was identified, since I was urged to go to Saudi Arabia at that point of time, I was unable to correct the date of birth in my first passport as 09.01.1980 instead of 12.04.1961."
5. However, it is seen that even at the time of the second renewal of the passport, the petitioner did not take steps to correct the date of birth. Now, after a lapse of 23 years, the present application has been submitted.
6. The learned Standing Counsel for the respondents has produced a judgment of this Court in W.P.No.16250 of 2025, dated 30.07.2025 (Manimaran Mahalingam v. Ministry of External Affairs), wherein the learned Single Judge, relying on the Official Memorandum of the respondents dated 22.09.2016, rejected a similar request for correction on the ground that it was made beyond the permissible period of five years. The said judgment squarely applies to the present case.
