Prayer: Writ Petition filed under Article 226 of the Constitution of India praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order in O.Mu.Aa3/4248/2024 dated 16.07.2024 passed by the fourth respondent, quash the same and consequently direct the second respondent to dispose the petitioner's representation/appeal dated 01.10.2024 filed against the fourth respondent's impugned order.

For Petitioner : Mr.R.Murugappan For R-1 to R-4 : Mr.A.Kannan Additional Government Pleader

O R D E R

Heard Mr.R.Murugappan, learned counsel for the petitioner and Mr.A.Kannan, learned Additional Government Pleader for the respondents.

2. This Writ Petition has been filed challenging the order of the fourth respondent dated 16.07.2024 and consequently direct the second respondent to dispose the petitioner's representation/appeal dated 01.10.2024 filed against the order dated 16.07.2024. 2/5

3. In view of the limited relief proposed to be granted by this Court, notice to the respondents 5 and 6 is dispensed with.

4. Even though the Writ Petition had been filed challenging the order of the fourth respondent dated 16.07.2024, the petitioner also seeks consequential direction against the second respondent to dispose of the appeal filed by him on 01.10.2024, as against the impugned order dated 16.07.2024.

5. Since the petitioner himself has preferred an appeal against the order of the fourth respondent dated 16.07.2024 before the second respondent, I am not inclined to entertain the Writ Petition as prayed for. However, I am inclined to direct the second respondent to consider the appeal dated 01.10.2024 filed by the petitioner against the order of the fourth respondent dated 16.07.2024, and dispose of the same, after affording a reasonable opportunity of hearing to the petitioner, respondents 5, 6 and any other interested parties, within a period of twelve (12) weeks from the date of receipt of a copy of this order. 3/5

6. With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 08.11.2024 NCC:yes/no Index:yes/no Internet:yes/no Nsr To:
