DECREE : This Appeal coming on for hearing on this day upon perusing the grounds of Appeal, the order of the Lower Court, and upon hearing the arguments of Mr.K.Bhaskaran, Advocate for the Appellant and of the Respondents not appearing in person or by Advocate, this Court doth order and decree as follows:-

1) that the award passed by Motor Accident Claims Tribunal-CumAdditional Sub Judge Kumbakonam dated 20.12.2010 made in M.C.O.P.No.300 of 2007, be and hereby is confirmed; and this appeal is dismissed.

2) That the appellant/Insurance Company be and is hereby directed to deposit the award amount less the amount already deposited and recover the same from the insured later.

3) That there be no cost in this appeal.
