ORDER

The petitioner has approached this Court that the order of this Court in WP.(MD)No.2336 of 2024 dated 08.07.2024, has not been complied with.

2.The learned Standing Counsel appearing for the respondent submits that a writ appeal has been filed, however, with a delay. The Division Bench of this Court has seized of the matter by issuing notice in the condone delay petition. 3.The learned counsel appearing for the petitioner submits that the respondent has preferred writ appeal as against the order passed in WP.(MD)No.25657 of 2024 dated 27.11.2024. 4.Heard the learned counsel on either side and perused the available materials.

5.This contempt petition is filed that the orders of this Court in WP.(MD)No.2336 of 2024 dated 08.07.2024 has not been complied with. The petitioner's request for compassionate appointment has been rejected by the respondent vide order dated 05.03.2022. Therefore, the petitioner has filed a writ petition in WP.(MD)No.2336 of 2024 and this Court disposed of the said writ petition remitting the matter to the respondent to consider the matter afresh and pass an order on merits of the application. The respondent has also passed another order based on the direction of this Court and that order is the subject matter in WP.(MD)No. 25657 of 2024. This Court allowed the said writ petition in favour of the petitioner. However, it appears that the respondent has filed a writ appeal as against the order in WP.(MD)No.25657 of 2024 dated 27.11.2024, however with a delay. The Division Bench has also entertained the condone delay petition by ordering notice.

6.From the materials it appears that the order of this Court dated 08.07.2024 has already been complied with by passing an order and the same was also went upto Division Bench. Therefore, this contempt petition is closed.
