Kaliswari : Respondent/Respondent PRAYER: Civil Miscellenous Appeal is filed under Section 19(1) of the Famil Courts Act, 1984, against the fair and executable order dated 12.11.2011 passed in H.M.O.P.No.93 of 2011 by the Family Court, Madurai.

For Appellant : Mr.J.Barathan For Respondent : Mr.T.Ajmal Khan for Mr.N.Anandapadmanaban JUDGEMENT [Judgement of the Court was delivered by K.RAVICHANDRABAABU, J] The present Civil Miscellaneous Appeal was filed by the husband, who lost before the Family Court in seeking divorce against the respondent/wife. During pendency of the above appeal, this Court, referred the matter to Mediation Centre of this Court for the purpose of resolving their disputes by way of mediation. Accordingly, the mediation took place and the Mediation and Conciliation Centre of this Court sent a report dated 16.02.2018 informing that both the parties have entered into mediation agreement, annexed with the report and settled the matter accordingly.

The terms of the agreement entered between the parties as annexed in the mediation report read as follows:- "Both sides, out of their own volition and without any pressure or coercion from any side have agreed as follows: 1.The petitioner/husband is ready for re-union with his wife/respondent and also ready to take his wife to the matrimonial home without any conditions.

amicably and ready to live as husband and wife. 3.In view of the above terms the petitioner/husband is ready to withdraw the C.M.A.(MD)No.1548 of 2011 to lead peaceful life.

4.There will be no further claim or demand from each other."

2.The above mediation report along with the terms of the agreement is taken on record.

3.The learned counsels appearing for both the parties submitted that the appeal may be disposed of in terms of the mediation report submitted as stated supra. Accordingly, this Civil Miscellaneous Appeal is disposed of in terms of mediation agreement, dated 16.02.2018 entered into between the parties. No costs.
