PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents No.1 to 4 herein to cancel the Patta No. 466 issued in favour of Nos.5 to 8 Respondent's father in connection with property comprised in Survey No.326/1A to an extent of 5 cents situated at Subramaniyapuram, Sivakasi Taluk, Virudhunagar District and 1/4
restore the same, on the basis of the petitioner's representation dated 10.01.2025 within time frame stipulated by this Court.

ORDER
After submitting the representation dated 10.01.2025 for cancellation of patta No.466, the present writ petition has been filed. 2.Learned Counsel for the petitioner relies upon the sale deed bearing document No.936 of 1954 in the name of the petitioner's grandfather and the relevant revenue records and partition deed bearing document No.4840 of 2024. He submits that the patta No.466 was unlawfully issued to Ramasamy Naickar without considering the petitioner's title to the property. 3.Learned Government Advocate accepts notice on behalf of the respondents 1 to 4. He has placed on record the written instructions received by him from the Tashildar to the effect that the recommendation has been made in relation to this issue to the Revenue Divisional Officer. He further submits that the petitioner's representation would be disposed of on merits within 12 weeks 2/4
from the date of receipt of a copy of this order. 4.Since the respondents 5 to 8 are the legal heirs of the pattadhars in patta No.466, it is just and necessary that reasonable opportunity be provided to them while considering the petitioner's representation. In view of this direction, notice to the private respondents in this writ petition is dispensed with. 5.Therefore, without expressing any opinion on the merits, this Writ Petition is disposed of by directing the third respondent to consider and dispose of the petitioner's representation dated 10.01.2025 on merits within 12 weeks from the date of receipt of a copy of this order after providing reasonable opportunity to the petitioner and the respondents 5 to 8.
