Prayer in CRL RC(MD). 1179/ 2024 :

To call for records and set aside the order passed by the learned Addl District and Session Judge, Periyakulam, in C.A No.48/2017 dt.26.09.2024 whereby imposed the fine on the Revision herein of a sum of Rs.250/- payable within one month to the Appellant failing which to undergo one month imprisonment and confim the order passed by the Learned Judicial Magistrate, Periyakulam in C.C.No.64/2007 dated 10.02.2017 and allow the above Criminal Revision Petition. Order : This Criminal Miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S. RAMESH.K.P, Advocate for the petitioner, while admitting the court made the following order:- This Criminal Miscellaneous Petition has been filed seeking an order to grant suspension of payment of fine amount of Rs.250/- (Rupees Two Hundred and Fifty 1/3

only) imposed on the petitioner/accused by the learned Additional District and Sessions Judge, Periyakulam in Criminal Appeal No.48 of 2017 vide order dated 26.09.2024.

2. Today, when the matter is taken up for hearing, the learned counsel for the petitioner/accused submitted that the fine amount of Rs.250/- (Rupees Two Hundred and Fifty only), imposed on the petitioner, has been paid to the learned counsel for the respondent/complainant. A memo, along with a copy of memo filed before the appellate Court, has been filed to that effect.

3. On perusal of those documents, it is seen that the aforesaid amount has been received by the learned counsel for the respondent/complainant. The said memo is recorded.

4. Since the fine amount has been paid, there is nothing remains to be adjudicated in the present petition.
