PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents No.1 to No.4 to take necessary action to survey the petitioners land by taking the assistance of the 5th respondent, bearing Survey No.3332/2, Ward No.6, Plot No.19, situated at Pudhupattinam Village, within the limits of Thanjavur District within a stipulated time that may be fixed by this Court.

O R D E R
After submitting an application seeking a survey of the land bearing Survey No.3332/2 at Pudhupattinam Village, Thanjavur District, the present writ petition has been filed.
2. Learned counsel for the petitioner relies on sale deed dated 21.12.1988 in favour of the petitioner. He further submits that the petitioner is a cancer patient and that survey has not been conducted in spite of the submission of an application along with the requisite fees. 2/5
3. Mr.B.Saravanan, learned Additional Government Pleader, accepts notice for respondents 1 to 4 and Mr.S.Prakash, learned Government Advocate, accepts notice for the fifth respondent.

By referring to the communication dated 07.04.2025 from the Surveyor, learned Additional Government Pleader points out that the survey could not be conducted because the Surveyor was not permitted to enter upon the relevant property. From the documents on record it appears that objections were raised by the Christu Raja High School, which is in occupation of the adjoining property. It also appears that the correspondent of the said school was put on notice. Before conducting a survey, it is just and necessary that the school be provided a reasonable opportunity.
5. Subject to the above observations, this writ petition is disposed of by directing the second to fourth respondents to take necessary action on the petitioner's application for survey after putting the Christu Raja High School on notice and providing them a reasonable opportunity. If necessary, for purposes of conducting such survey, the fifth respondent 3/5
shall provide necessary assistance. The entire exercise shall be concluded within eight weeks from the date of receipt of a copy of this order. No costs.
