ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the second respondent not to harass the petitioner and her family members without following the due process of law.

2.The learned counsel for the petitioner would submit that FIR was registered against the petitioner and others, for the offence under Sections 328 IPC; 6(b), 24(1) of Cigarette and other Tobacco Products At, 2003 and Section 77 of Juvenile Justice (Care and Protections of Children) Act, 2015 and that the petitioner has already obtained anticipatory bail and she has not complied with the conditions. But, the second respondent without any notice has directed the petitioner to appear before concerned Magistrate for executing a bond under Section 110 Cr.P.C.

3. It is not the case of the prosecution that the petitioner is having some other cases. Since the petitioner has not complied with the conditions of this Court, it is open to the prosecution to file an application for cancellation of anticipatory bail. 2/4

4. Considering the above, the prosecution is directed not to harass the petitioner and they are at liberty to file a petition for cancellation of anticipatory bail granted to the petitioner.

5. With the above directions, this Criminal Original Petition stands disposed of.
