ORDER : The Court made the following order :- The petitioner/A10, who apprehends arrest at the hands of the respondent Police for the offence under Sections 8(c),20(b) (ii)(c), 25 and 29(i) of NDPS Act in Crime No.15 of 2023 on the file of the respondent Police, seeks anticipatory bail. 1/3

2. It is seen from records that the earlier bail petition filed by the petitioner in Crl.O.P.(MD).No.1937 of 2024 was dismissed on merits by an order dated 16.02.2024.

3. The learned counsel appearing for the petitioner relying upon the orders passed in Crl.O.P.(MD).No.3857 of 2024, dated 13.03.2024, Crl.O.P.(MD).No.2716 of 2024 dated 25.03.2024 and Crl.O.P.(MD).No.4967 of 2024, dated 28.03.2024 submitted that all the accused persons viz., Accused Nos.5, 8 and 6 have been granted bail.

4. In the considered view of this Court, the above orders pertain to arrest of the accused persons, who were later enlarged on bail. The petitioner is said to be Accused No.10 in this case. When the earlier petition is dismissed on merits, without any change in circumstances, the present anticipatory bail petition cannot be entertained.
