PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 2nd respondent herein to take immediate action to sub divide and issue individual separate patta to the petitioner in respect of the property comprised in S.No.8/13C, situated at Vaiyampatti village, Manapparai Taluk, Trichy District on the basis of the petitioner's online application, dated 04.12.2017 within the time stipulated by this Court.

O R D E R

This writ petition has been filed for a direction to the 2nd respondent herein to take immediate action to sub divide and issue individual separate patta to the petitioner in respect of the property comprised in S.No.8/13C, situated at Vaiyampatti village, Manapparai Taluk, Trichy District on the basis of the petitioner's online application, dated 04.12.2017.

The petitioner purchased the property to an extent of 2651 square feet, out of a total extent of 86 cents, in Survey No.8/13C at Vaiyampatti Village, Manapparai Taluk, Trichy District vide Document No.3393/2004. Since then, the petitioner had been in peaceful possession and enjoyment without any let or hindrance. A joint patta was issued to the petitioner for the aforesaid property along with 16 others. As the petitioner proposed to construct a residential house in the said land, he applied through online on 04.12.2017, for issuance of separate patta in his name. The petitioner stated that as no action was taken on his application, even though 7 years lapsed, he was constrained to file the writ petition for the aforesaid relief.

3. It is seen that the application for separate patta was submitted by the petitioner on 04.12.2017 and even after a lapse of 7 years, the respondents have not processed the same. In the light of the above facts, a direction is issued to the 2nd respondent to consider the petitioner's application, dated 04.12.2017 and pass orders on merits and in accordance with law within a period of eight (8) weeks from the date of receipt of copy of this order.

4. With the aforesaid directions, the writ petition stands disposed of. No costs.
