Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 2 to grant an adequate continuous police protection to the petitioner for the peaceful administration and management of the Khazi Yeomiah Wakf and its institutions by preventing unlawful interference by respondents 3 to 6 within a time frame fixed by this Court.

ORDER

The petitioner has sought for a direction to the respondents 1 and 2 to provide adequate police protection to the petitioner for the peaceful administration and management of the Khazi Yeomiah Wakf and its institutions by preventing unlawful interference by the respondents 3 to 6.

2. According to the petitioner, he had obtained a decree in his favour and the issue has attained finality as the appeal challenging the said decree was also dismissed. Admittedly, there are disputes between the petitioner and the respondents 3 to 6 as regards the management of the Wakf in question. Hence, this Court is of the view that the respondent Police cannot interfere in such disputes and determine as to who is entitled to manage the Wakf. Consequently, there cannot be any direction to the respondent Police to provide police protection. It is for the petitioner to take steps to execute the decree in the manner known to law.

3. With the above observations, this Writ Petition stands dismissed. There shall be no order as to costs.
