PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue Writ of Certiorarified Mandamus, calling for the records of the Respondent relating to his impugned order in Na.Ka.No.1913/E/2016, dated 27.09.2016 and quash the same and directing the respondent to pay pension to the petitioner, which he received previously to the impugned order, based on the earlier calculation by fixing his pension as Rs.10,650/-. O R D E R

The petitioner has joined as a Teacher in Ammapettai Panchayat Union Primary School on 25.03.1960 and he has retired on 30.09.1987 as a Headmaster. After his retirement, he was receiving pension for a sum of Rs.10,650/- per month. While so, the Sub Treasury Officer/the respondent has passed an order in his proceedings in Na.Ka.No.1913/E/2016, dated 27.06.2016, stating that instead of paying Rs.7,855/- towards pension, they have paid a sum of Rs.10,650/- to this petitioner and therefore, the petitioner was directed to remit back the difference amount. Challenging the same, the petitioner has approached this Court in the year 2017. 2.This writ petition was entertained by this Court on 23.01.2017 and an order of interim stay has been granted and therefore, there was no recovery from this petitioner. 2/4

3.Today(03.01.2025), when this writ petition is taken up for hearing, the learned Special Government Pleader appearing for the respondents by producing a copy of the death Certificate of the petitioner submits that the petitioner died on 05.06.2017 and therefore there is no question of recovery.

4.Recording the submission made by the learned Special Government Pleader, this writ petition is closed. No costs. Consequently, connected Miscellaneous Petitions are closed. 03.01.2025 NCC:Yes/No Index:Yes vrn To The Sub Treasury Officer, Sub Treasury, Pattukkottai, Thanjavur District.
