ORDER

The petitioner / A6, who was arrested and remanded to judicial 1/4

custody on 13.06.2024 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29(1) of NDPS Act, in Crime No.520 of 2023 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 25.09.2023 at about 08.0o hours. On the secret information, the respondent police went to the place of occurrence, i.e., near to the garden of Sithamparam, Karumpatti at Dindigul, and found 5 persons sitting and opening gunny bags and taking down the ganja. On seeing the police party, the accused tried to escaped from the scene of occurrence. However, they nabbed the accused except two. On searching, the remaining accused were found in illegal possession of 25 kg of ganja. Hence the case.

The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He would further submit that he has been arrested and remanded to judicial custody on 13.06.2024. Therefore, prayed to grant bail for the petitioner.

that the quantity involved in this case is a commercial quantity and the petitioner is having 3 previous cases similar in nature.

5. This Court heard both sides and perused the materials available on record.

Considering the rival submissions made by the learned counsel on either side, nature of offence, and the quantity involved in this case is a commercial quantity and the petitioner is having 3 previous cases for the similar kind of offence and the petitioner has failed to satisfy the conditions contemplated under Section 37 of the NDPS Act and already trial was commenced, this Court is not inclined to grant bail to the petitioners, at this stage.
