PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to disburse the gratuity amount and other service benefits with interest payable to the petitioners by considering the representation dated 07.10.2024 within the time limit that may be fixed by this Court. ORDER
The writ petition has been filed seeking for Mandamus to direct the respondents to disburse the gratuity amount and other service benefits with interest payable to the petitioner, by considering the petitioner's representation dated 07.10.2024
2. It is the case of the petitioners that they are the employees of the Madurai urban Corporation Society, for which the fourth respondent has been appointed as the liquidator of the said Society. As of today, with regard to the payment of gratuity, the co-operative bank under liquidation had availed a Master Insurance Policy and that after its maturity, a sum of Rs.3,14,58,489/- has now been deposited into the account of the bank 2/5
and that the said amount will be utilized to disburse the gratuity payable to the employees of the bank under liquidation and the same cannot be utilized for any other purpose.
3. The bank went into liquidation in the year 2005 and it is almost 20 years and that the employees have not been benefited with the payment of gratuity and other service monetary benefits. 4.Considering the fact that the Masters Insurance Policy of a sum of Rs.3,14,58,489/- had been credited with the fourth respondent bank account on 06.06.2023, there shall be direction to the fourth respondent to utilize the said amount only for disbursing the gratuity amount to the employees and the said amount cannot be utilized for any other purpose.
5. With the above directions, this writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs. 29.10.2025 tta 3/5
