Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent to provide adequate police protection on the basis of petitioner's representation dated 26.10.2024 for the conduct of debate organized by the petitioner to develop the knowledge and language skill of the students of Thenur Village proposed to be scheduled on 10.11.2024 at Thenur Village Kottara Kalaiarangam.

ORDER

This Writ Petition has been filed to direct the respondents to provide adequate police protection on the basis of petitioner's representation dated 26.10.2024 for the conduct of debate organized by the petitioner to develop the knowledge and language skill of the students of Thenur Village proposed to be scheduled on 10.11.2024 at Thenur Village Kottara Kalaiarangam.

2. The petitioner, claiming to be a Secretary of Suliyam Ilaingar Narpani Mandram, had sent a representation to the Superintendent of Police, Madurai, on 26.10.2024 and sent a copy to the second respondent.

3. The contention of the petitioner is that the petitioner to educate the student used to conduct debate and this debate is being held and 2/6

conducted for more than 25 years and they are proposed to conduct debate on 03.11.2024 between 06.00 pm and 10.30 pm. in Thenur Alagumalaiyan Chavadi Kottara Kalaiarangam. According to the petitioner, it is an open area and it is a public place that all the villagers participate. The petitioner sought for police permission for using sound system and for protection. The respondent police are yet to act on the petitioner's representation.

4. The learned Additional Public Prosecutor submitted that the function was to be held on 03.11.2024 and the representation sent on 26.10.2024 and the same was received on 28.10.2024. The verification on the representation could not be done within the short period.

5. In the meanwhile, one Anbu Muthusamy lodged a complaint against the petitioner and C.S.R.No.823 of 2024 was assigned on 07.11.2024. When the petitioner was called for enquiry, not responded. The event date was on 03.11.2024 and it is now over. 3/6

The learned counsel for the petitioner submitted that Anbu Muthusamy is an encroacher, who encroached upon the public place, which has been objected by the petitioner, hence, false complaint given. He further submitted that the petitioner not aware of C.S.R.No.823 of 2024. It is also submitted that now, event has been rescheduled and it is to be held on 17.11.2024.

7. The learned Additional Public Prosecutor submitted that petitioner to appear before the second respondent, submit the list of organizers, participants and not to use micro phone and only use sound system which is permitted and not to create any law and order issue/ public disturbance.

8. The petitioner is directed to approach the second respondent on 12.11.2024. On filing such undertaking, the second respondent police to consider the representation and pass appropriate orders. It is reminded that event is to be held on 17.11.2024 and hence, appropriate steps are to be taken well before that.

9. With the above directions, the Writ Petition stands disposed of . No costs.
