JUDGMENT

The learned counsel for the first respondent states that O.S.No.145 of 2009, on the file of the Principal District Court, Virudhunagar at Srivilliputtur, dated 09.11.2009, has already been dismissed for default. The learned counsel for the appellant in C.M.A.(MD).No.304 0f 2011, states that the application for restoring the said suit has been filed and it is pending as on date.
