ORDER

This writ petition has been filed directing the 1st respondent to renew the petitioner's passport bearing No.M8655655 dated 29.04.2015 based on the petitioner's application No.MD1075068790225 on 15.05.2025. 2.

Heard Mr.J.Jeyakumaran, learned counsel for the petitioner and Mr.G.Ramanathan, learned Central Government Standing Counsel for the first respondent and Mr.S.Prakash, learned Government Advocate [Crl side] for the respondents 2 to 4.

3. It is the contention of the petitioner that his application for reissuance of passport has not been acted by the first respondent on the ground of adverse report received from the second respondent.

4. The learned Government Advocate (Crl.side), on instructions, would submit that criminal cases are pending against the petitioner. 2/5

5. In the considered view of this Court, the law on this issue is now too well settled. As per the decision of the Division Bench of this Court in The Regional Passport Officer, Chennai vs. Samsudeen Mohamed Salih and another (W.A. No.902 of 2023 dated 02.06.2023), there can be no impediment to direct the first respondent to act upon the passport application of the petitioner. Hence, there shall be a direction to the first respondent to process the application of the petitioner and re~issue the passport in the name of the petitioner within a period of one month from the date of receipt of a copy of this order, if the petitioner satisfies all the other requirements. If the petitioner wants to go abroad, the petitioner has to necessarily seek for the permission from the Court where the criminal cases are pending.
