For Respondent : Mr.M.Sakthi Kumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Cr No.160/2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Section 379 of IPC in Crime No.160 of 2022 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner has illegally transported 3 units of saral sand by using the vehicle. Therefore, the present case came to be registered. 3.This is the third anticipatory bail application filed by the petitioner. Earlier applications were dismissed by this Court on the ground that the petitioner is having similar previous cases pending against him and also he is a habitual offender. Now this petition has been filed without any change of circumstances. 4.The learned counsel for the petitioner would repeat the very same argument that by mistake the registration number of the vehicle https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.22443 of 2022 was mentioned in the number plate. But for assessing the ownership of the vehicle the learned Additional Public Prosecutor was required to produce the Registration Certificate extract. It has also been produced, wherein, we find that the ownership name was mentioned as Kottai Muthu. By forging the permit, the above said transport of sand has been made. As I mentioned earlier, the petitioner has previous cases of similar in nature.

5.The petitioner has to surrender before the trail Court concerned and seek regular bail. I find no reason to entertain this petition. This petition deserves to be dismissed. Accordingly, dismissed.
