Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to disburse the petitioner's retirement benefits and monthly pension as per the proceedings of the fifth respondent in P09/10923204/2/R0923204 dated 01.07.2019 along with interest. O R D E R

Under the Tamil Nadu Pension Rules, the respondents would be justified in withholding the retirement benefits and monthly pension, whenever the departmental proceedings have been instituted against the Government servants. Admittedly, the departmental proceedings are pending before the concerned Authority against the petitioner and as such, the prayer sought for in the present writ https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.26846 of 2019 petition seeking for disbursement of the retirement benefits is not feasible.

2.Nevertheless, since the writ petitioner is now aged about 59 years, the third respondent shall endeavour to conclude the disciplinary proceedings initiated against the petitioner as expeditiously as possible.

3. Accordingly, this Writ Petition stands closed. No costs.
