ORDER

Heard the learned counsel on either side.

2. The petitioner is an holder of an Indian passport. He seeks issuance of passport.

3. It appears that a criminal case is pending against the petitioner. The learned Government Advocate (Crl.side) informs the Court that final report has been filed. But it is yet to be taken on file by the jurisdictional Magistrate. I therefore would treat the case as pending only at the FIR stage.

4. There is no impediment for processing the petition mentioned application. The first respondent is directed to process the same and issue passport to the petitioner subject to fulfilment of all the usual formalities.

5. The Writ Petition is allowed. No costs.
