Civil Revision Petition is filed under Article 227 of the Constitution of India to direct the learned Sub Court, Periyakulam to expedite the suit in O.S.No.85 of 2020 and to dispose the same within a time to be fixed by this Court.

ORDER

This Civil Revision Petition has been filed seeking a direction to dispose of the suit in O.S.No.85 of 2020 pending on the file of the Sub Court, Periyakulam within the time stipulated by this Court.

2. Heard the learned counsel appearing for petitioner. Mr.B.Saravana, learned Additional Government Pleader takes notice for the respondents 3 to 5. Since the revision is filed for seeking early disposal, no notice is necessary to the other respondents.

The learned counsel appearing for the revision petitioner submitted that the above said suit has been filed by the respondents 1 and 2 / plaintiffs for declaration and injunction against the revision petitioner / 5th defendant and others and the same is being adjourned for the past four years without assigning any valid reason and therefore, the said suit may be disposed of within the time stipulated by this Court. 2/5

Having been taken into consideration of the material facts and circumstances and that the said suit is pending for the past four years, this Court is of the view that in the interest of justice, a direction may be issued to the learned Subordinate Judge, periyakulam to dispose of the said suit as expeditiously as possible.

Accordingly, this Civil Revision Petition is disposed of with a direction to the learned Subordinate Judge, Periyakulam to dispose of the said suit in O.S.No.85 of 2020 pending on his file within a period of six months from the date of receipt of a copy of this order on merits and in accordance with law. No costs.
