To condone the delay of 565 days in filing the above Criminal Revision Petition against the Cr.M.P.No. 2933 of 2023 in Cr.M.P. No. 3025 of 2017 in M.C. No. 14 of 2016 the file of the Learned Judicial Magistrate No.II, Kovilpatti, dt. 17.11.2023.

ORDER

Heard Mr.G.Radhakrishnan, learned counsel for the Petitioner and Mr.F.X.Eugene, learned counsel for the Respondents. 2.The learned Counsel for the Petitioner submits that this Criminal Miscellaneous Petition has been filed under Section 5 of the Limitation Act, 1963, seeking to condone the delay of 565 days in filing the criminal revision petition against the order passed in Crl.M.P.No. 2933 of 2023 in Cr.M.P.No.3025 of 2017 in M.C.No.14 of 2016 dated 17.11.2023 by the learned Judicial Magistrate No.II, Kovilpatti. 3.Mr.F.X.Eugene, learned counsel for the Respondents, has stated that he has no objection to allowing this petition. 4.Being satisfied with reasons stated in the affidavit filed in support of this Criminal Miscellaneous Petition, the delay of 565 days in filing the above criminal revision petition is condoned, however, on payment of costs.

5.Accordingly, this petition is ordered on payment of Rs. 5,000/- (Rupees Five Thousand only) to the High Court Legal Services Authority attached to this Bench within a period of two weeks from the date of receipt of a copy of this order, failing which this petition will be dismissed automatically without any further reference to this Court.

6. Registry is directed to number the Criminal Revision Petition, if it is otherwise in order.
