RESPONDENT/RESPONDENT/ RESPONDENT/COMPLAINANT Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to exempt the petitioner from surrendering pursuant to the sentence imposed by the District Munsif cum Judicial Magistrate, Vedasandur, Dindigul District in C.C No. 54/2021 vide judgment dt. 18.04.2022 which was subsequently confirmed by the Additional District & Sessions Court, Dindigul in C.A.No.20/2022 vide judgement dated 29/10/2024 so as to press an application for suspension of sentence before this Hon'ble Court pending the disposal of the main criminal revision. Prayer in CRL RC(MD). 1150/ 2024 :

To call for the entire records pertaining to the judgment delivered by the District Munsif cum Judicial Magistrate, Vedasandur, Dindigul District in C.C No. 54/2021 vide judgment dt. 18.04.2022 by convicting the petitioner under sec 138 of Negotiable Instruments Act and sentenced him to undergo 6 months S.I. and to pay a compensation of Rs.5,00,000/- to the Respondent within one month with 6% interest per annum in default 3 months S.I which was subsequently confirmed by the 1/3

Additional District & Sessions Court, Dindigul in C.A.No.20/2022 vide judgement dated 29/10/2024 and set aside the same and consequently acquit the petitioner honorably.

Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.M.PITCHAI MUTHU, Advocate for the petitioner, While admitting the Criminal Revision Case, the court made the following order:- When the matter is taken up for hearing today, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw this petition, and has also made an endorsement in the bundle to that effect.
